Terms of Use
1. Parties and scope
The By1 platform is operated by [to be added]. These terms apply when you use the By1 apps, the partner web panel and by1market.com. By using the service you accept these terms.
2. The service
By1 is an intermediary platform that connects independent restaurants and markets (businesses) with customers and organises delivery by couriers. Businesses prepare and sell the products; product contents, quality, allergen information and legal compliance are the business's responsibility. If you have an allergy, ask the business before ordering. The service is available only in the areas shown in the app.
3. Account
You must be at least 18 to create an account. You sign in with a one-time code sent to your email; you are responsible for the security of your email account. Enter your name and phone number correctly, as delivery relies on them.
4. Orders and prices
Businesses set their prices. The basket total, delivery fee and discounts are shown at checkout; the amount calculated by our server is the valid amount. An order is confirmed when the business accepts it. A business may reject an order, for example when an item is sold out.
5. Payment
You pay the courier on delivery, in cash or by card. The app never asks for card details.
6. Cancellation and delivery problems
You can cancel an order free of charge in the app until the business accepts it. Later cancellations require the business's agreement. If a delivery is missing items, wrong or damaged, email [email protected] within 24 hours; depending on the outcome of our review, the amount concerned is refunded or the item is sent again.
7. Delivery
Delivery times shown are estimates. You must be reachable at the delivery point you chose; if the courier cannot reach you within a reasonable time, the order may be cancelled.
8. Products not sold
Tobacco, tobacco products, e-cigarettes and alcoholic drinks are not sold on the platform.
9. Coupons and offers
Each coupon's conditions are shown with it. Coupons cannot be exchanged for cash and may be cancelled in case of abuse.
10. Reviews
Reviews must reflect your real experience. We may remove reviews containing insults, personal data or misleading content.
11. Acceptable use
You may not use the platform for unlawful purposes, place fake orders, use someone else's account or try to disrupt the system. If you find a security vulnerability, report it to [email protected].
12. Closing your account
You can delete your account in the app at any time. We may suspend or close accounts that seriously breach these terms.
13. Liability
We take reasonable care to provide the platform securely and without interruption. The business concerned is responsible for damage caused by its products. To the extent permitted by law, our liability is limited to the amount of the order concerned; this limit does not apply to intent, gross negligence or liability that cannot be limited by law.
14. Changes
We may update these terms and will announce significant changes in the app.
15. Governing law
These terms are governed by the law of the Turkish Republic of Northern Cyprus, and [to be added] has jurisdiction over disputes. Mandatory consumer protection rules of the country where you live remain unaffected.
